TERMS OF SERVICE:

Use of Service

All Services may only be used for lawful purposes. The laws of the United States of America apply to all Clients of DealSites. 

You agree to indemnify and hold harmless Omni AIs from any claims resulting from your use of Omni AIs Services. You represent and warrant to Omni AIs that you are eighteen (18) years of age or older. Any use of or access to the Services by anyone under eighteen (18) years of age is prohibited.

If you use the Services on behalf of another party, you agree that you are authorized to bind such other party to this Agreement

and to act on such other party's behalf with respect to any actions you take in connection with the Services.

Use of the Omni AIs Services to infringe upon any copyright or trademark is prohibited. This includes but is not limited to unauthorized copying of Business, Sales Script, music, books, photographs, Logo, Name or any other copyrighted work. The offer of sale of any counterfeit merchandise of a trademark holder will result in the immediate termination of your account. 

 Any account found to be in violation of another's copyright will be expeditiously removed, or access to the material disabled. 

 Any account found to be in repeated violation of copyright laws will be suspended and/or terminated. 

 If you believe that your copyright or trademark is being infringed upon, please email support@omniais.com with the information pertaining to your claim.​

It is your responsibility to ensure that software being use for rightful purpose and should not use for spamming or unwanted calls, You must use required APIs or other which is not mentioned here to run Omni AIs properly .  

Clients are responsible for all actions taken under their account. This includes the compromise of credentials such as Client name and password.  You must use a secure password.

Solely for the purpose of providing the Services, you hereby grant to Omni AIs the right and license to access, store and use any content provided by you, and to remove all or any portion of such content if you violate the provisions of this Agreement.

Omni AIs may from time to time, and at any time, monitor your use of the Services to ensure your compliance with the provisions of this Agreement.

All the Single Payment License & service have 12 months support & updates. We do not provide support beyond 12 months unless you purchase extra credits or recurring payment mode. After 12 months, you can use the product as it is and might have to use external resource/API to function it properly. 

Zero-Tolerance SPAM Policy

Omni AIs has zero-tolerance for Clients using unsolicited Calls, unsolicited e-mailing, and SPAM. "Safe lists," purchased lists,Purchased Cold Call Numbers and selling of lists will be treated as SPAM. 

Any Client who sends out SPAM Calls or emails, text message, Audio Message, Video Message or anything using Omni AIs will have their account terminated, and may be terminated without notice. Additionally, Clients who engage in unsolicited actions will, at Omni AIs' own discretion, be charged a consulting fee of two hundred fifty dollars ($250) per hour for any remedial actions that Omni AIs elects to take in the event that, as a result of a Client's activities, 

Omni AIs servers, APIs or IP space are placed in any third-party mail filtering software or blackhole lists.

To protect the API & IP reputation of our network, and as a proactive measure to prevent our API, IP space from being used to distribute unsolicited Calls e-mail,  Wereserves the right to apply an Call/SMTP filter as a precaution to accounts flagged by our Abuse Team. You can not call unwanted phone numbers, You can not call unknown Numbers, You can not run a call for long duration. Call maybe disconnect due to internal and external issues like Network, AI detection that Client is not interested, not answering and other factors and we are not responsible. If our system detects abuse of Omni AIs Service, It can Ban You, can ask to use your Own API to call and other actions which you have to comply. 

Backups and Data Loss

Your use of our Services is at your sole risk. Since Omni AIs is a AI Calling & Messaging Software that place calls so we do not know what data stored and action you doing with the Software. Our servers are setup with RAID to constantly mirror all data to a second disk. 

Omni AIs  is not responsible for any action, reaction, results , files and/or data stored on its servers. You agree to take full responsibility for Actions, files and data transferred and to maintain all appropriate backups of files and data stored on its servers. Omni AIs does not take backups  of any kind of customer data, customer's are responsible for managing and backing up their own data.

In the event that such interruptions are being caused, we would notify the Client, informing them they need to upgrade to their own API. 

In extreme cases, the service would be suspended to prevent further server or service interruptions. The service would also be suspended

if the Client does not contact us after warning emails regarding the need to upgrade have been sent.

Server Abuse/Customer Abuse

Any attempted attack against any Omni AIs server and/or Client being hosted by us will result in automatic termination of the offending account with no refund including, but not limited to, no refunds for advanced payments, and a permanent banning of the offending Client.

Disclaimer

We shall not be responsible for any damages a Client's business may suffer. This includes loss of data resulting from delays,  no deliveries, wrong delivery, and any and all service interruptions caused by Omni AIs and its Clients. Omni Ais makes NO WARRANTIES of any kind, expressed or implied for Services provided. Omni AIs makes NO WARRANTIES of MERCHANTABILITY or FITNESS for a particular purpose.
